Essential Documents for Property Purchase

Buying property is a dream for someone. To fulfill a dream, one must know the basic requirement to achieve it. In India, buying property is considered a risk-free and profitable investment that serves to be a great deal for the future. However, it is a tricky process to obtain this investment.

Buying a space can be a tedious task as it demands a lot of official paperwork and formalities. It is safe to have a checklist of documents that are essential for buying a property. 

1. Sale Deed
Sale Deed is one of the most significant legal documents. It acts as proof of sale and actual transfer of property from the seller to the purchaser. It confirms that the ownership of the property is in the name of the rightful buyer. Every investor must get the sales deed registered by the required authorities. It is advisable that the investor must clear all charges that apply to the property—for example, electricity charges, water charges, property tax, maintenance charges, etc. 

2. Mother Deed
It is a pivotal document that traces the origin and history of ownership of the property. It is a document that helps in the further sale of the property by inculcating new ownership. In case of missing ownership mentions, you may refer to the records of registering offices or revenue records. The previous records must be updated before entering current records.

3. Building Approval Plan
Get the building approval plan sanctioned by the jurisdictional commissioner or respective government authorities. However, the authorities sanction the building plan based on zonal classification, road width, floor area ratio, and plot depth. To obtain the building approval plan, one must need to submit a few documents. They are as follows –

  1. Title Deed
  2. Property PID Number
  3. City Survey Sketch
  4. Up-To-Date Tax Paid Receipt
  5. Property Drawings
  6. Foundation Certificate and Demand Drafts

4. Khata Certificate / Khata Extract
Khata certificate is the account of a seller or owner of the property. It is required for the registration of new property or transfer of a property.
Khata Extract is for obtaining property details from the assessment registrar.

5. Encumbrance Certificate
It ensures that no dues or obligations toward the property. It can be obtained from the sub-registrar’s office. The EC would have a record of all the transactions done during a stipulated period over the property, proving all the purchases/sales, any transaction, or the presence of a mortgage. The time taken to obtain the EC is 3-7 working days depending on the period sought.

6. Tax Receipts and Stamp Duty
The tax receipts ensure that the taxes on the property are clear and up-to-date. It is essential to inquire the authorities about dues as it can be a problematic task if the taxes are not cleared. The purchaser is advised to properly check the original receipts and look out for details like the taxpayer’s name, date of the payment, owner’s name, etc. In case the owner does not have a tax receipt, you may contact the municipal body along with the survey number of the property to confirm the ownership of the land.
Stamp duty is a similar tax to sales tax collected by the government. It is an instrumental legal document during the possession of property. 

7. No Objection Certificate (NOC)
The seller should provide you with a copy of the urban non-ceiling no – objection certificate and NOCs for various things. For example – Electricity, Water, and other utilities.
